Harvey Weinstein is seeking to get the criminal case against him thrown out of court.

His lawyers filed a defence motion citing emails they say Weinstein received from one of his accusers after an alleged rape: “These communications irrefutably reflect the true nature of this consensual intimate friendship, which never at any time included a forcible rape.”

They say that the case should be dismissed in its pre-trial stage as there had been a series of failings including a lack of details on the timeline of an alleged assault and the lack of advanced warning about the presentation of more serious charges.

The New York District Attorney’s Office has not yet commented.

CBS has started an investigation into allegations of sexual misconduct against top executive Les Moonves.

President Kelly Kahl said: “All allegations need to be and are being taken seriously.”

CBS has hired two law firms and appointed former US Securities and Exchange Commission Chair Mary Jo White to lead a probe into the allegations and the broader culture at CBS.

It also set up a special board committee, recusing Moonves from the investigation but leaving him in his job as CBS chief.

The Guardians of the Galaxy Cast has called for James Gunn to be reinstated as director of the third movie in the series after he was fired over old tweets.

Chris Pratt, Bradley Cooper, Zoe Saldana and Vin Diesel signed an open letter in support of Gunn and said they were shocked by his removal.

Disney Studios Chairman Alan Horn said the tweets, in which Gunn joked about rape and pedophilia, were “indefensible” and “inconsistent with our studio’s values”.

A worker at a detention center for undocumented child migrants in Arizona has been arrested after a teenage girl told police he had sexually assaulted her 14 year old roommate.

Fernando Magaz Negrete is accused of sexually abusing the girl several times throughout the night after he entered the bedroom she shares with two other migrants.

The witness said she saw Negrete kissing her roommate, touching her inappropriately, pushing him away from her and trying to get away from him.

He has been charged with molestation, aggravated assault and sexual abuse.

Police say he has admitted to kissing and groping the girl.

A spokesman from Southwest Key, the organisation that houses more than 1,500 migrant children, said that Negrete was fired when the incident was reported.
